Introduction

Welcome to resum8. These Terms of Service ("Terms") govern your access to and use of the resum8 website, application, and services (collectively, the "Service"). By creating an account or using our Service, you agree to be bound by these Terms.

Please read these Terms carefully before using resum8. If you do not agree to these Terms, you may not access or use our Service.

1. Acceptance of Terms

By accessing or using resum8, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

2. Changes to Terms

2.1 Right to Modify

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email (to the address associated with your account) and/or through a notice on our Service. Material changes will take effect 30 days after notification.

2.2 Continued Use

Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service and may cancel your subscription as described in Section 6.

2.3 Version History

We maintain a public changelog of significant changes to these Terms. The current version and effective date are displayed at the top of this document.

3. Account Registration and Security

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Using a strong, unique password

3.3 Account Sharing

You may not share your account credentials with others or allow multiple individuals to access your account. Each user must have their own account. Violation of this provision may result in immediate termination of your account.

3.4 Account Responsibility

You are solely responsible for any and all activities conducted through your account, whether or not you authorized such activities. If you believe your account has been compromised, you must notify us immediately at [email protected].

3.5 Account Deletion

You may delete your account at any time through the account settings page. Upon deletion:

• Your access to the Service will be terminated immediately
• Your subscription will be canceled (no refunds for partial billing periods)
• Your data will be handled according to our Privacy Policy and data retention policies

3.6 Inactive Accounts

We reserve the right to deactivate or delete accounts that have been inactive for 12 consecutive months. We will provide 30 days' notice before deactivation to your registered email address.

4. Subscription Plans and Pricing

4.1 Service Tiers

resum8 offers multiple subscription tiers with different features and usage limits:

• 24-hour cooldown between CV generations (1 CV generation per 24 hours)

All paid tiers include:

• Unlimited position scans (no cooldowns)

• Priority email support (response within 48 hours)

4.2 Free Trials

Quarterly, Semi-Annual, and Annual plans include a free trial period as specified above. The Monthly plan does NOT include a free trial.

During the trial period, you have full access to all paid features. If you do not cancel before the trial ends, you will be automatically charged for the first billing period.

Free trials are available only to new subscribers who have not previously subscribed to a paid plan. We reserve the right to limit free trial availability or verify eligibility.

4.3 Subscription Billing

Paid subscriptions are billed in advance on a recurring basis according to your selected plan:

• Monthly: Every month on the day you subscribed
• Quarterly: Every 3 months on the day you subscribed
• Semi-Annual: Every 6 months on the day you subscribed
• Annual: Every 12 months on the day you subscribed

If a billing date falls on a day that does not exist in a given month (e.g., the 31st in a month with only 30 days), billing will occur on the last day of that month.

4.4 Price Changes

We reserve the right to change our pricing at any time. For active paid subscriptions, price changes will take effect at the start of your next billing cycle after we provide you with at least 30 days' advance notice.

If you do not agree to a price increase, you may cancel your subscription before the new price takes effect. Canceling before the price increase will allow you to continue using the Service at the old price until the end of your current billing period.

4.5 Currency and Taxes

All prices are listed in US Dollars (USD) unless otherwise specified.

Prices do not include applicable taxes, which will be added to your invoice where required by law. You are responsible for paying all applicable taxes associated with your subscription. If you are tax-exempt, you must provide valid tax exemption documentation.

4.6 No Refunds for Downgrades

If you downgrade from a paid plan to the Free Tier or to a lower-priced plan, the change will take effect at the start of your next billing cycle. You will not receive a refund or credit for the remaining time in your current billing period.

5. Billing and Payment Terms

5.1 Payment Methods

We accept payment via credit card, debit card, or other methods made available through our payment processor (Stripe). By providing payment information, you:

• Represent that you are authorized to use the payment method
• Authorize us to charge the payment method for all fees incurred
• Agree to keep your payment information current and valid

5.2 Automatic Billing

By subscribing to a paid plan, you authorize resum8 to automatically charge your payment method at the start of each billing period. You will receive a receipt via email after each successful payment.

5.3 Failed Payments

If a payment fails:

• We will attempt to process the payment again within 7 days
• You will be notified via email of the failed payment
• If payment fails after 7 days, your subscription may be downgraded to the Free Tier
• Access to paid features will be suspended until payment is successful
• You are responsible for any fees charged by your bank or payment provider due to insufficient funds or payment failures

5.4 Updating Payment Information

You can update your payment information at any time through the account settings page or Stripe Customer Portal. It is your responsibility to maintain valid payment information on file.

5.5 Payment Disputes

If you dispute a charge with your payment provider (chargeback), we reserve the right to immediately suspend or terminate your account and access to the Service. You will be responsible for any fees or costs we incur as a result of the chargeback, including chargeback fees charged by payment processors.

6. Cancellation and Refunds

6.1 Canceling Your Subscription

You may cancel your subscription at any time through:

• Account settings page on resum8.org
• Stripe Customer Portal (link provided in billing emails)
• Contacting [email protected]

Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that time.

6.2 Refund Policy

Our refund policy is as follows:

Free Trial Cancellation:

If you cancel during a free trial period, you will NOT be charged, and your subscription will not begin.

Cancellation During Paid Period:

If you cancel after being charged for a billing period, you will NOT receive a refund for that period. You will retain access to paid features until the end of the billing period you paid for.

No Partial Refunds:

We do not provide refunds or credits for partial billing periods. If you cancel mid-cycle, you will have access until the end of your paid period but will not receive a prorated refund.

6.3 Exceptions and Extraordinary Circumstances

We may consider refund requests on a case-by-case basis in extraordinary circumstances, such as:

• Technical issues that prevented you from using the Service for an extended period
• Billing errors caused by our system
• Other exceptional circumstances at our sole discretion

6.4 Effect of Cancellation

When your subscription ends (either by cancellation or non-payment):

• Your account will automatically downgrade to the Free Tier
• You will be subject to Free Tier limitations (24-hour cooldowns, limited features)
• Your data (CVs, positions, account information) will be retained according to our Privacy Policy
• You may resubscribe at any time, but free trial eligibility may not apply to returning subscribers

7. Acceptable Use Policy

7.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. Specifically, you agree to use the Service only to:

• Create accurate and truthful CVs for legitimate job applications
• Tailor your CVs to specific job opportunities
• Prepare for job interviews
• Manage your professional career materials

7.2 Prohibited Activities

You agree NOT to:

Service Misuse:

• Create false, misleading, or fabricated CVs or professional information
• Use the Service to impersonate another person or misrepresent your identity or qualifications
• Upload or process content that you do not have the right to use
• Share your account credentials or allow unauthorized access to your account
• Attempt to circumvent usage limits, cooldowns, or subscription restrictions

Technical Violations:

• Reverse engineer, decompile, disassemble, or attempt to derive source code from the Service
• Use automated scripts, bots, or scrapers to access or interact with the Service
• Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems
• Probe, scan, or test the vulnerability of our systems or networks
• Interfere with or disrupt the Service, servers, or networks connected to the Service

Illegal or Harmful Conduct:

• Use the Service for any illegal purpose or in violation of any local, state, national, or international law
• Upload viruses, malware, or other malicious code
• Harass, abuse, threaten, or harm other users or our staff
• Transmit spam, unsolicited messages, or promotional material through the Service
• Use the Service to engage in fraudulent activities or scams

7.3 Enforcement and Consequences

We reserve the right to investigate and take appropriate action against anyone who violates this Acceptable Use Policy, including:

• Removing or disabling access to content that violates these Terms
• Suspending or terminating your account and access to the Service
• Reporting violations to law enforcement authorities
• Taking legal action, including seeking injunctive relief and damages

We are not obligated to monitor user content or conduct, but we reserve the right to do so at our discretion.

8. Intellectual Property Rights

8.1 Service Ownership

The Service, including all content, features, functionality, software, code, designs, graphics, and user interface, is owned by resum8, our licensors, or other content providers. All rights, title, and interest in and to the Service are and will remain the exclusive property of resum8 and our licensors.

8.2 Limited License to Use Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Access and use the Service for your personal, non-commercial purposes
• Create, edit, and export CVs for your own job applications
• Use features provided through the Service

This license does not permit you to resell, redistribute, or commercially exploit the Service or any portion thereof.

8.3 Your Content Ownership

You retain ownership of all content you submit to the Service, including your CV information, work history, education, skills, and other professional data ("Your Content"). By submitting Your Content to the Service, you grant resum8 a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and process Your Content solely to provide the Service to you and as described in our Privacy Policy.

8.4 AI-Generated Content Ownership

The Service uses artificial intelligence to generate tailored CV content based on Your Content and job descriptions you provide. You own the AI-generated output created from your inputs.

However, you acknowledge that AI models may generate similar or identical outputs for different users given similar inputs. We do not guarantee uniqueness of AI-generated content, and we are not liable if similar content appears in other users' CVs.

8.5 Trademarks

"resum8" and our logos, service marks, and trade names are trademarks or registered trademarks of resum8. You may not use our trademarks without our prior written consent. Other trademarks, service marks, and trade names appearing on the Service are the property of their respective owners.

8.6 Feedback and Suggestions

If you provide feedback, suggestions, or ideas about the Service, you grant resum8 an unlimited, perpetual, irrevocable, royalty-free license to use, modify, and incorporate such feedback without any obligation to you. This includes the right to use your suggestions in future product development.

9. Content Accuracy and Your Responsibility

9.1 Your Responsibility for Content Accuracy

You are solely responsible for:

• The accuracy and truthfulness of all information in your CVs
• Reviewing and editing all AI-generated content before use
• Ensuring your CVs do not contain false, misleading, or fabricated information
• Compliance with all applicable employment laws and regulations

9.2 AI Limitations

While our AI is designed to optimize and tailor your CV content, it:

• May occasionally produce inaccurate, incomplete, or inappropriate suggestions
• Cannot verify the truthfulness of information you provide
• Should not be relied upon as legal or career advice
• May not perfectly match every job posting or ATS system

9.3 Your Obligation to Review

You MUST:

• Carefully review all AI-generated content before using it in job applications
• Verify that all information accurately represents your experience and qualifications
• Remove or modify any content that is inaccurate, misleading, or inappropriate
• Ensure your final CV complies with your professional standards and applicable laws

You are responsible for:

• Correcting any errors or inaccuracies in AI-generated text
• Adapting content to your specific situation and voice
• Ensuring compliance with all applicable laws regarding employment applications

9.4 No Guarantees of Outcomes

resum8 does not guarantee that using the Service will result in:

• Job interviews or job offers
• Increased callback rates or hiring success
• Specific outcomes in your job search
• Approval by any particular ATS or hiring system

While we strive to optimize your CV for ATS systems and hiring best practices, many factors outside our control affect hiring decisions.

9.5 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Guarantees of uninterrupted, timely, secure, or error-free service
• Accuracy, reliability, or quality of any AI-generated content
• Results from using the Service

9.6 Limitation of Liability for Content

resum8 is not liable for:

• False or misleading information you include in your CV
• Consequences of inaccurate AI-generated content that you fail to review and correct
• Hiring decisions made by employers based on your CV
• Any claims by employers or others regarding misrepresentation in your job applications

10. Limitation of Liability

10.1 Types of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESUM8, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

Indirect and Consequential Damages:

• Lost profits, revenue, or business opportunities
• Lost data or content
• Loss of goodwill or reputation
• Costs of substitute services
• Any indirect, incidental, special, consequential, punitive, or exemplary damages

Service-Related Damages:

• Inability to use the Service
• Interruptions, errors, or downtime
• Deletion, corruption, or failure to store your content
• Unauthorized access to or alteration of your content
• Any other matter relating to the Service

10.2 Job Search Outcomes

We are specifically not liable for:

• Failure to secure job interviews or employment offers
• Rejection by employers or ATS systems
• Missed job opportunities or career setbacks
• Any employment-related outcomes or decisions

10.3 Third-Party Actions

We are not liable for:

• Actions or decisions of employers, recruiters, or hiring managers
• Third-party service failures (e.g., payment processors, hosting providers)
• Compatibility issues with job boards or application systems
• Third-party content or websites linked from our Service

10.4 Maximum Liability Cap

IN NO EVENT SHALL RESUM8'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, INCLUDING NEGLIGENCE, WARRANTY, OR OTHERWISE) EXCEED THE AMOUNT YOU PAID TO RESUM8 IN THE 12 MONTHS PRECEDING THE CLAIM.

If you have not paid any fees to resum8, our maximum liability is limited to $100 USD.

10.5 Applicability

These limitations apply:

• Regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise)
• Even if resum8 has been advised of the possibility of such damages
• Even if a remedy fails of its essential purpose
• To the fullest extent permitted by applicable law

10.6 Legal Exceptions

Some jurisdictions do not allow the exclusion or limitation of certain damages. If you are in such a jurisdiction, some or all of the above limitations may not apply to you, and you may have additional rights.

11. Indemnification

11.1 Your Indemnification Obligation

You agree to indemnify, defend, and hold harmless resum8, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all:

• Claims, demands, actions, or proceedings
• Losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees)

arising from or related to:

Your Use of the Service:

• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any third-party rights (including intellectual property, privacy, or defamation)

Your Content:

• Inaccurate, false, or misleading information in your CVs or applications
• Claims by employers, recruiters, or others regarding misrepresentation
• Any content you submit, upload, or transmit through the Service

Your Conduct:

• Unauthorized use of the Service
• Prohibited activities described in Section 7
• Any harm caused to other users or third parties

Specific Examples:

• Claims by employers regarding false information in your CV
• Intellectual property infringement claims related to your content
• Damage to resum8's reputation caused by your conduct
• Costs incurred investigating or defending against claims arising from your use of the Service

11.2 Defense and Settlement

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with us in asserting any available defenses. You may not settle any claim without our prior written consent.

11.3 Limitation

Your indemnification obligation does not apply to claims arising solely from our negligence, breach of these Terms, or violation of law.

12. Termination

12.1 Termination by You

You may terminate your account at any time as described in Section 3.5 and Section 6 (Cancellation).

12.2 Termination by resum8

We may suspend or terminate your access to the Service, with or without notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service or interference with other users
• Non-payment of subscription fees
• Prolonged inactivity
• Any other reason at our sole discretion

12.3 Effect of Termination

Upon termination:

• Your right to access and use the Service immediately ceases
• Paid subscriptions are not refunded (except as required by law)
• Your data will be handled according to our Privacy Policy and data retention policies
• Sections of these Terms that by their nature should survive termination will continue to apply (including intellectual property, indemnification, limitation of liability, and dispute resolution provisions)

12.4 No Liability for Termination

We are not liable to you or any third party for termination of your account or access to the Service, provided such termination is in accordance with these Terms.

13. Modifications to the Service

13.1 Right to Modify

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including:

• Features, functionality, or user interface
• Availability of AI models or capabilities
• Pricing, plans, or subscription options (with notice as described in Section 4.4)
• Technical infrastructure or service providers
• Content, tools, or resources

13.2 No Obligation to Maintain Features

We have no obligation to maintain, support, or provide any particular features, services, or compatibility with third-party platforms. Features may be added, modified, or removed at our discretion.

13.3 Notice of Material Changes

For material changes that significantly impact your use of the Service, we will provide reasonable notice:

• Email notification to your registered email address
• In-app notification when you log in
• Notice period: At least 30 days for material changes (where feasible)

Continued use of the Service after changes take effect constitutes acceptance of the modified Service.

14. Dispute Resolution and Governing Law

14.1 Governing Law

These Terms and any disputes arising out of or related to them or the Service shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.

14.2 Jurisdiction and Venue

You agree that any legal action or proceeding between you and resum8 shall be brought exclusively in the courts of England and Wales. You consent to the personal jurisdiction and venue of such courts and waive any objection to such jurisdiction or venue.

14.3 Informal Dispute Resolution

Before filing a legal claim, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will work with you in good faith to resolve the matter within 60 days.

14.4 Alternative Dispute Resolution

If we cannot resolve a dispute informally, either party may pursue mediation through a mutually agreed mediator before resorting to litigation. Mediation costs will be shared equally unless otherwise agreed.

14.5 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AND RESUM8 AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

This class action waiver does not apply where prohibited by law, including in certain jurisdictions within the European Union or as required by consumer protection laws in England and Wales.

14.6 Exceptions

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

14.7 Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer under UK or EU consumer protection laws. If you are a consumer in the UK or EU, you may have additional rights that cannot be waived or limited by these Terms.

15. Miscellaneous Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms you agree to when using specific features, constitute the entire agreement between you and resum8 regarding the Service and supersede all prior agreements, understandings, and communications, whether oral or written.

15.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15.3 Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of that provision or any other provision. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign, transfer, or delegate these Terms or your account without our prior written consent. We may assign these Terms or any rights hereunder to any party without your consent. Any attempted assignment in violation of this section is void.

15.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

15.6 Relationship of Parties

Nothing in these Terms creates a partnership, joint venture, agency, franchise, employment, or fiduciary relationship between you and resum8. You have no authority to bind resum8 or incur any obligation on our behalf.

15.7 Notices

All notices to resum8 under these Terms shall be in writing and sent to [email protected]. We may provide notices to you via email to your registered email address, through the Service interface, or by posting on our website. Notices are deemed given:

• Email: 24 hours after sending (if no bounce-back received)
• In-app notification: Upon display in the Service
• Website posting: Upon publication

15.8 Headings

The section and paragraph headings in these Terms are for convenience only and have no legal or contractual effect.

15.9 Translation

These Terms may be translated into other languages for your convenience. In the event of any conflict or inconsistency between versions, the English language version shall prevail.

15.10 Export Control

You agree to comply with all applicable export and import control laws and regulations in your use of the Service. You represent that you are not located in a country subject to a UK or US Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any UK or US Government list of prohibited or restricted parties.
